When it comes to criminal cases involving non-fatal injuries, forensic medical information can make a decisive difference. In the Netherlands, public prosecutors play a crucial role in ensuring that justice is supported by reliable medical evidence. But how often is this information used, what challenges exist, and what can be done to improve the process?

Why Forensic Medical Information Matters

Forensic medical reports help prosecutors understand the severity, timing, and possible causes of injuries. This information is especially vital in cases of severe abuse, attempted manslaughter, sexual assault, and domestic violence. Injury dating, for example, can clarify when harm occurred and strengthen links between events and suspects.

What the Study Found

A survey among twelve prosecutors across eight Dutch police regions highlighted both the value and the challenges of using forensic medical reports:

  • Valuable in Serious Cases: Prosecutors viewed forensic input as crucial, particularly in situations involving permanent or repeated injuries, often linked to domestic violence.

  • Concerns Over Quality and Access: Reports from treating physicians were not always complete, clear, or easy to obtain.

  • Barriers Identified:

    • Time pressures during investigations

    • Shortage of forensic doctors

    • Unclear police procedures

    • Privacy concerns from medical professionals

    • Limited awareness among prosecutors themselves

Recommendations for Improvement

To overcome these challenges, prosecutors recommended:

  • More training opportunities to raise awareness of the importance of forensic medicine

  • Appointment of specialized staff to handle injury-related cases

  • Stronger collaboration between police, prosecutors, and medical experts

  • Clear and consistent procedural guidelines for handling medical information

Conclusion

This study emphasizes the growing need to better integrate forensic medical expertise into Dutch criminal proceedings. Addressing the barriers and implementing these recommendations can lead to a more efficient, effective, and fair judicial process.

By strengthening the collaboration between law and medicine, justice for victims of non-fatal injuries can be pursued with greater precision and integrity.
